The regulations of the portal whatcanido.eu

§ 1 Definitions

• Portal – the internet service owned by the Administrator placed at whatcanido.eu including a set of the websites within which the Administrator provides the e-services

• Portal Administrator: Mateusz Warzocha – COTUROBIC.INFO MATEUSZ WARZOCHA, al. gen. Władysława Sikorskiego 254, 35-304 Rzeszów, NIP: 8133002427 (Contractor)

• E-service – a service delivered online, in an automated way consisting in sending and receiving the data by means of information and communication technology systems in public telecommunications networks; individualized (offered at the User’s individual request) and provided by means of the internet service without a parallel presence of both parties in one location

• User (Consumer) – natural person, legal person and an organization unit not having a legal entity, yet the regulations grant it a legal subjectivity; it can use the portal and services on the service whatcanido.eu

• Newsletter – an electronic letter sent with the User’s consent, on their e-mail address entered in the form, including administrative, marketing and commercial information

• Personal data Administrator – here: Mateusz Warzocha – COTUROBIC.INFO MATEUSZ WARZOCHA, al. gen. Władysława Sikorskiego 254, 35-304 Rzeszów (Contractor), who processes the User’s personal data, which is essential to establish, form the content, change , cancel and realize properly the services delivered online

• Payment – transaction settlement by means of credit card or e-transfer made by the User via paypal.com systems

• Registration form – online form used by the Contractor during the User’s (Consumer’s) registration procedure which enables passing the necessary to the registration data to the Contractor

• Entries – comments and other content on the portal

• Forum – discussion forum available for the registered Users; allows the User to place comments and hold a discussion

§2. General provisions

1. The following regulations stipulate the rules of using the portal whatcanido.eu

2. The portal is dedicated mainly to natural persons interested in tourism, spending free time in a particular location and organizing spare time. It does not exclude the legal persons and an organization unit not having a legal entity, yet the regulations grant it a legal subjectivity

3. Using the portal whatcanido.eu and during the registration process, the User confirms that they are familiarized with its content and accepts all the provisions.

§3. Portal content. Services delivery

1. If the registration is not necessary, the Administrator enables the Users to get the access to the free content which include:

- the information concerning the Contactor and financing the portal by EU funds

- the description of the functionality and benefits delivered by the portal

- entry to advertisers’ and affiliates’ portals by clicking their banner adverts

- familiarizing with the regulations of using a portal

2. The paid services as a part of the Portal functionalities offered by the Contactor are:

- an application which enables to generate a list of suggestions of spending free time on the basis of individualized parameters defined by the User. The main (specific) functionality of the e-service enables the User to choose from many suggestions of spending free time. The choice will be made on the basis of specified by the User parameters, e.g. a way of spending free time, the accepted distance between the events and the User’s abode, age bracket, date, potential admission fees, weather conditions, etc. Using the mentioned e-service enables to:

- optimize spending the User’s free time

- save financial resources

- save time devoted to searching the desirable way of spending free time

- obtain discount vouchers (E-service 1).

- an application which enables to generate the individualized Tourist Guide on the basis of parameters defined by the User. The main (specific) functionality of the mentioned e-service enables the User to create the individual Tourist Guide on the basis of criteria specified by the system. Once the User has answered the questions , they receive the access to the professional and complex tourist information. It includes only the areas which the User is interested with. Moreover, the crucial thing is that the partially sighted can benefited from this service. It is possible because of the module which reads the information out. (E-service 2).

3. The User has to register in order to obtain the access to the paid services.

4. The Administrator provides the registered User with a free access to the forum. They also can enroll on a mailing list so that they could receive newsletters.

5. The User declares that they accept that the selected services offered by the Portal are to be paid.

6. In order to use the content from the Portal and the offered services, the following specifications have to be made:

- a computer with the access to the Internet,

- a software for browsing websites

7. It is possible to use the portal via mobile devices like a smartphone.

§4. Registration, agreement conclusion and termination.

1. The registration consists in completing a form available on

http://whatcanido.eu/uzytkownicy/rejestracja

2. It is necessary to fill in the data specified in the form during the registration process. The data are entered in the designated fields on the User’s profile.

3. The registration on the whatcanido.eu Portal is free. The User declares that they are acquainted with the content of the regulations and accepts it.

4. The User guarantees that the data given during the registration are true.

5. The User hereby agrees for their personal data to be processed in accordance with the Law on Personal Data Protection of 29 August 1997 (Law Gazette No.133, heading 883, as amended).

6. The registration process is the condition of the commencement of using Services mentioned in §3 po. 2-4. The User has to conduct the registration process by means of completing and sending the Form and accepting the provisions of the regulations.

7. Along with the registration and provisions acceptance, the User becomes the party of the act on rendering electronic devices concluded between the User and the Contractor.

8. If the agreement is concluded with the User who is a consumer in the meaning in art. 22.1 of the civil code , they can withdraw from this agreement up to 10 days from the agreement conclusion. In order to do that, the User is obliged to send the statement on the Administrator’s e-mail address until the period of 10 days has elapsed.

9. In accordance with art 10 act 3 po 1 from 2 March 2000 concerning the consumer protection and the responsibility for the damage with dangerous product. (Law Gazette from 31 March 2000 as amended). The User who is a consumer agrees to begin to provide the services until the period of 10 days has elapsed. Taking the abovementioned into consideration, the User (Consumer) does not have the right to withdraw from the agreement from a distance in accordance with art.10 act 3 po 1 from 2 March 2000 concerning the consumer protection and the responsibility for the damage with dangerous product. (Law Gazette from 31 March 2000 as amended).

10. Each party can terminate the contract forthwith.

11. The User can withdraw the contract by means of submitting a demand of an account removal to the Administrator’s e-mail address admin@coturobic.info, or by removing it individually. In case when the User reports such a request to the Administrator, their account will be removed within 24 hours.

12. The termination of the contract occurs by removing the User’s account.

13. The User will be notified about the account’s removal via e-mail or text message.

14. The User’s registration on the portal creates the User’s Account automatically. The User has the access to it by means of login and password they obtain during the registration process.

§5. Rules of using E-service 1.

The application which enables to generate the list of suggestions of spending free time.

1. The User can use the application in any place and any time (on the stipulation with §7) via a computer/laptop on condition that one has the efficient, public access to the Internet regardless of the installed browser.

2. In order to generate e-service 1via the application, the User has to define the following parameters:

- categories (gastronomy, entertainment, sightseeing, shopping, culture, accommodation)

- the distance between the attractions

- additional options (facilities for children, the handicapped, car park, only positively rated, only with a photo)

3. Defining parameters is of a closed nature.

4. The system will generate the individualized e-service after the choice of all parameters. It will be available for the User after the payment has been made. They will be informed about this by means of a special message sent by an e-mail or text message.

5. The message will contain the information about the fee and possible ways of paying for it.

6. The purchase comes by clicking the button “Buy it now”. The User will be directed to the site with payment system where they can make a choice of the way of the payment. After the choice has been made, the process of the payment proceeds according to the selected way of payment.

7. The e-service bought by the User becomes available at the moment the information about the payment settlement is received. The User will be informed about this via e-mail or text message (information about service availability).

§6. Rules of using E-service 2.

An application that enables to generate the Tourist Guide.

1. The User can use the application that enables the generation of the Tourist Guide in any place and any time (on the stipulation with §7) via a computer/laptop on condition that one has the efficient, public access to the Internet regardless of the installed browser.

2. The User who wants to buy e-service 2 does not have to be a purchaser of the e-service 1.

3. The User who has been registered while using e-service 1, does not have do the registration again.

4. In order to generate e-service 1via the application, the User has to define the following parameters:

- categories (gastronomy, tours, sightseeing, shopping)

- the length of the route

- the number of attractions

- the start and end points of the route

- approximate time of the ride

5. Defining parameters is of a closed nature.

6. The system will generate the individualized e-service after the choice of all parameters has been made. It will be available for the User after they have done the payment. They will be informed about this by means of a special message sent by an e-mail or text message.

7. The message will contain the information about the fee and possible ways of paying for it.

8. The purchase comes by clicking the button “Buy it now”. The User will be directed to the site with payment system where they can make a choice of the way of the payment. After the choice has been made, the process of the payment proceeds according to the selected way of payment.

9. The e-service bought by the User becomes available at the moment the information about the payment settlement is received. The User will be informed about this via e-mail or text message (information about service availability).

§7. The access to the information and materials from the purchased e-services 1 and 2.

1. After the payment has been made, the User obtains the access to the information and materials as a part of offered services for the period of 12 months from the date the User is informed about the availability of the paid service.

2. After the deadline has passed, the User saves the password and login yet the access to the information as a part of paid services will be no longer available. It will require another selection process of the paid service and payment.

§8. Payment

1. The User can make the selection of the following methods of payment:

a/ electronic transfer

b/ credit card

2. The transactions by credit card and e-transfer are conducted via PayPal (paypal.com) payment system.

3. Making payments via paypal.com means the User’s acceptance of the User Agreement for PayPal Service

5. In case of the payment made via a text message, the fee for sending a text message to the indicated number will be calculated by the User’s mobile telecommunications operator.

6. The Contractor can acknowledge the discount codes.

7. The User can use the discount code which entitles to get a discount on the e-service in case of the purchase of the second service of this type and another after the second e-service.

8. During making the payment, the Consumer can enter the discount code which has been previously sent via e-mail or text message and entitles to get a discount on e-service.

9. After the payment has been made and previous verification of its correctness by the system, the Customer will get the confirmation of transaction via e-mail or text message.

§9. Newsletter

1. The registered User can order the service’s newsletter.

2. The newsletter’s order is free.

3. The User can at any time resign from the subscription sending the information about the resignation on the Administrator’s e-mail address mentioned in the Regulations.

4. The newsletters are sent on the User’s mailbox.

5. Once the User has ordered newsletter, they agree that commercial information and advertisers will be sent on their e-mail address by the Administrator.

§10. Using a forum

1. The registered User has the right to use the forum on the portal.

2. The Administrator provides all the Users, who are registered and accepts the regulations, with the access to the forum.

3. The User registers their presence on the forum by means of their ID (Nick).

4. A Nick cannot be: similar to the other User’s on the forum, commercial sign or vulgar expression. These kinds of nicks will not be accepted.

5. The forum is solely the area of the User’s free expression. The Users are the ones who are responsible for the content displayed on the forum.

6. The content of the commercial nature or protected by the copyright or related rights and industrial property rights cannot be placed.

7. The Administrator has the right to block the access to the content which infringes the rights, e.g. the Regulations, laws or which are incompatible with portal’s subject matter or which are offensive and contrary to decency. The Administrator has also the right to delete the abovementioned content.

8. The Administrator has the right to make the technical cuts which can make using forum impossible.

9. Any remarks and reservations concerning the forum can be diverted to the Administrator on the e-mail address mentioned in the Regulations.

§11. Price list of the services

1. E-service 1 – “List of suggestions of spending free time”: 4 PLN gross

2. E-service 2 – “Tourist Guide”’: 8 PLN gross

§ 12. Complaints

1. Any irregularities concerning functioning of the payment for the service on our portal can be complained. In order to do that a user has to register a complaint to the Administrator.

2. The complaints can be registered on the e-mail address stronie kontaktowej

3. Any complaints concerning the payment made by the user will be investigated up to 14 days from the day the notification is received.

§ 13. Protection of personal data

1. During the registrations process and completion of a registration from, the User agree their personal data in the form and those given as a part of using the service to be placed in the Administrator’s database. They also agree the abovementioned data to be processed, according to the Act from 22. August 1997 about protection of personal data (Law Gazette 2002 No. 101, heading 926 as amended) in order to deliver the services (also commercial and informational). They also agree their data to be processed in the future if the purpose mentioned above will not change, according to art. 23 of the mentioned act.

2. The Administrator of the personal data according to the Act from 22 August 1997 about protection of personal data Law Gazette 2002 No. 101, heading 926 as amended) is the subject indicated in §1 of these regulations. It is called the personal data Administrator.

3. The data Administrator can entrust the other subject with data procession according to art. 31 of the act mentioned above from 29 August 1997 about personal data protection. The written contract has to be concluded.

4. The data Administrator takes care of the security of the personal data they have and protects them from the unauthorized access.

5. The Administrator provides the User with the access to the current information about the available technical means which prevent from acquiring and modifying the data by the unauthorized.

6. The User has the right to see and modify their personal data.

§14. Administrator’s (Contractor) responsibility

1. The Administrator makes efforts to make the Portal working correctly.

2. The Administrator does not bear responsibility for the failure in the power supply, turning off the system because of its maintenance.

3. The Administrator does not bear responsibility for the content of the displayed adverts and entries made by the users.

4. Any information and materials displayed and available via services offered by the portal are of informational and educational nature. The purpose is to convey the information, which facilitate travel planning, and to advance knowledge about tourism. They do not replace the professional tourist map. They cannot be treated as the only source of the tourist map of Poland.

§15. Final provisions

1. The issues which cannot be regulated by the abovementioned regulations they are subject to Polish law.

2. The abovementioned Regulations can be changed by the Administrator anytime.

3. Any changes in the Regulations will apply from the date they are placed on the Portal.

4. Using a Portal after the amendments means the acceptance of the amended Regulations.

5. The abovementioned Regulations have been in effect since 1 January 2014.
